Welcome to Fixigo. These Terms & Conditions govern your use of the Fixigo Customer App, Fixigo Partner App, website, and all related services. By accessing or using our platform, you agree to comply with these Terms. If you do not agree, please discontinue using the platform.

1. Definitions

• Fixigo refers to the platform providing roadside assistance services.
• Customer refers to a user requesting services.
• Partner refers to an approved service provider.
• Service Request means a roadside assistance booking created through the platform.
• Platform includes our website, mobile applications, and related services.

2. Eligibility

Users must be legally capable of entering into binding agreements under applicable law. Partners must provide valid identification and any required documents before offering services.

3. User Accounts

• Provide accurate information during registration.
• Keep your login credentials confidential.
• You are responsible for activities performed through your account.
• Notify Fixigo immediately if your account is compromised.

4. Services

Fixigo facilitates on-demand roadside assistance including but not limited to:

• Fuel Delivery
• Battery Jump Start
• Flat Tyre Assistance
• Puncture Repair
• Towing Services
• Emergency Roadside Assistance

Availability depends on your location, service providers, weather conditions, and operational constraints.

5. Pricing

Estimated pricing is shown before confirmation. Final charges may vary depending on distance, waiting time, additional services requested, taxes, tolls, or applicable platform fees.

6. Payments

• Payments may be made through supported payment methods.
• Wallet balances may be used where available.
• Customers authorize Fixigo to process payments for completed services.
• Partners receive payouts according to the platform's payout schedule.

7. Cancellations

Customers may cancel a booking before it is accepted without charge. Cancellation fees may apply after a partner has accepted or started travelling. Repeated unnecessary cancellations may lead to account restrictions.

8. Partner Responsibilities

• Maintain valid documents.
• Provide services professionally.
• Arrive safely and promptly.
• Follow traffic and safety laws.
• Treat customers respectfully.
• Keep account information accurate.

9. Customer Responsibilities

• Provide an accurate service location.
• Provide accurate vehicle information.
• Cooperate during service delivery.
• Pay applicable charges.
• Treat partners respectfully.

10. Live Tracking

Customers may track the assigned partner during an active service request. Partners agree to share live location while actively providing services. Tracking stops after completion or cancellation.

11. Ratings & Reviews

Both customers and partners may rate each other after service completion. Reviews must be truthful, respectful, and free from offensive or misleading content. Fixigo reserves the right to remove inappropriate reviews.

12. Prohibited Activities

• Fraudulent bookings.
• Providing false information.
• Harassment or abusive behaviour.
• Unauthorized account access.
• GPS manipulation.
• Uploading fake documents.
• Circumventing platform fees.
• Violating applicable laws.

13. Suspension & Termination

Fixigo may suspend or terminate accounts that violate these Terms, engage in fraudulent activity, abuse the platform, or pose a safety risk.

14. Intellectual Property

All Fixigo trademarks, logos, software, designs, content, graphics, and intellectual property remain the exclusive property of Fixigo or its licensors. Users may not copy, modify, or distribute platform content without written permission.

15. Limitation of Liability

Fixigo acts as a technology platform connecting customers and service providers. While we strive to provide reliable services, we do not guarantee uninterrupted availability or specific outcomes. To the maximum extent permitted by law, Fixigo shall not be liable for indirect, incidental, special, or consequential damages arising from use of the platform. Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

16. Indemnity

You agree to indemnify and hold Fixigo harmless from claims, damages, liabilities, and expenses arising from your misuse of the platform, violation of these Terms, or infringement of third-party rights.

17. Privacy

Your use of the platform is also governed by the Fixigo Privacy Policy, which explains how personal information is collected, used, and protected.

18. Changes to Terms

Fixigo may update these Terms & Conditions from time to time. Updated versions become effective when published on our website or within the application. Continued use of the platform constitutes acceptance of the revised Terms.

19. Governing Law

These Terms shall be governed by the laws of the Republic of India. Any disputes shall be subject to the exclusive jurisdiction of the competent courts where Fixigo operates, unless otherwise required by law.
